Without prejudice to the said minimum annual payment, either the Govern- ment or the Company may require a revision of the rate per word or of the method of computing the said royalty from time to time by three months previous notice in writing; but such revision shall not be made unless the average rates of charges by the Company to the public have been increased or reduced by more than 25% since the date of this Agreement or since the last revision. In default of agreement between the Government and the Company with regard to such revision the matter shall be referred to arbitration in accordance with the provisions of Article 25.

ARTICLE 9.

In particular the Company undertakes, within a period of twenty-four months from the signature of this Agreement to provide, maintain and operate stations in the Colony of Hong Kong giving efficient radio-telegraphic and radio-telephonic service with Great Britain and Singapore and efficient radio-electric communication with all other places heretofore served by the Hong Kong Radio Services acquired by the Company.

ARTICLE 4.

The rights granted and the obligations undertaken under this Agreement shall continue and endure from the date hereof until the date of expiration or sooner termination of the Licence and Agreement of the 4th day of September, 1929 be- tween The King's Most Excellent Majesty and the Board of Trade of the first part, His Majesty's Post Master General of the second part and the Company of the third part authorising the maintenance and working of certain wireless telegraph stations.

ARTICLE 10.

The Company undertakes to charge for radio-telegrams rates which are not greater than those at present in force for telegraphic traffic by cable to similar points, or rates which shall in future be agreed upon between the Governor of Hong Kong and the Company being reductions of the present rates, provided that there shall be special reduced rates for Government and other agreed special classes of radio- telegrams.

ARTICLE 5.

Subject to the approval of the Secretary of State for the Colonies such land as may be agreed upon as necessary for the erection and maintenance of radio-elec- tric stations, aerial systems and buildings appertaining thereto shall be placed at the disposal of the Company by lease, licence or otherwise on such terms and condi- tions as may be agreed upon in each-case---

ARTICLE 6.

The Company shall be permitted to maintain the same direct access to the public in connection with its communications service as that now enjoyed by the Eastern Extension, Australia and China Telegraph Company Limited.

ARTICLE 11.

IN RESPECT

THEREOF

The rates to be authorised for radio-telephonic or other services shall be fixed AND ROYALTIES by agreement between the Governor and the Company and failing such agreement shall be determined by the Governor in Council. In fixing such rates provision shall be made for special reduced rates for Government and other agreed special classes of services.

ARTICLE 12.

ARTICLE 7.

The Company shall if so requested by the Government of Hong Kong permit its communications service to be connected with the Hong Kong Government sys- tem of telephony and with the system of telephony of the Hong Kong Telephone Company Limited on such terms as the Governor in Council after discussion with the Companies concerned shall consider reasonable.

The Company undertakes, pending the installation of its own offices and sta- tions in the Colony, to take over on agreed terms, and to operate as from the first day of April, 1981, or such later date as may be agreed, all the fixed station commer- cial radio-electric services of the Colony now operated by the Government of Hong Kong and for this purpose to take on agreed terms a sub-lease of such portion of the Government Radio Office and to purchase at an agreed valuation or rent at agreed terms all such plant and stocks of wireless stores as are required to carry on the Hong Kong Radio Services acquired by the Company.

ARTICLE 8.

The Company undertakes to provide, maintain and operate at its own expense the stations required to give efficient radio-electric communication at all times with all places heretofore served by the Hong Kong Radio Services acquired by the Com- pany and also with such other places and in such manner as the Governor may re- quire, subject to the approval of the Secretary of State for the Colonies, and pro- vided that reasonable notice of such requirements is given to the Company.

ARTICLE 13.

The Company undertakes to make good to the Government any increase in the cost of pensions incurred by reason of the abolition of office or by reason of the termination of Government employment of those officers whose services will not be required by the Government after this Agreement comes into operation.
